Terms and Conditions
§ 1 Scope, contracting parties
(1) These Terms and Conditions apply to all contracts concluded between

and the customer through the online store at chi-drops.com.
(2) The offer is directed exclusively at consumers within the meaning of Section 13 of the German Civil Code, meaning natural persons who enter into a legal transaction for purposes that are predominantly outside their trade, business or profession. Sales to businesses, legal entities and resellers are excluded.
(3) These Terms and Conditions apply exclusively. Differing terms proposed by the customer are not recognized unless the provider expressly agrees to them in writing.
(4) The contract language is German.
§ 2 Formation of the contract
(1) The presentation of products in the online store does not constitute a legally binding offer, but a non-binding invitation to place an order.
(2) By clicking the "Buy now" or "Order with obligation to pay" button, the customer submits a binding offer to conclude a purchase contract for the goods in the cart.
(3) The provider confirms receipt of the order without delay by email. This order receipt confirmation does not yet constitute acceptance of the contractual offer. The contract is formed as soon as the provider accepts the order through an express order confirmation or by shipping the goods.
(4) The order data is stored by the provider and is available to the customer after the contract is formed, in the order confirmation and in their customer account.
§ 3 Prices, shipping costs and import charges
(1) All prices stated in the online store are in euros and include any applicable excise duties.
(2) Because the goods ship from a warehouse outside the European Union (Asia), import VAT and, where applicable, customs duties and other official fees arise on import into the EU or Switzerland. These charges are borne by the customer and are usually collected directly by the delivery service provider on delivery. The amount depends on the order value and the rules in force in the destination country.
(3) Shipping costs are shown separately during the order process before the order is placed. From an order value of $50.00 the provider ships free of charge (shipping costs in the narrower sense; import charges under paragraph 2 remain unaffected).
§ 4 Payment
(1) Payment is made, at the customer's choice, through one of the payment methods offered during the order process:

- PayPal
- Klarna
- Credit card
- Apple Pay
- Google Pay
(2) The purchase price is due for payment when the contract is formed. If Klarna or comparable payment services are selected, the terms of the respective provider apply in addition.
(3) In the event of late payment, the provider is entitled to claim default interest at the statutory rate and, where applicable, reminder costs.
§ 5 Delivery, delivery time, retention of title
(1) Delivery takes place within 7 to 10 business days from dispatch. The shipping period begins on the day after the contract is formed. If payment in advance is selected, the period begins only on the day payment is received.
(2) Shipping takes place from an international warehouse of the provider; delivery is usually handled by DHL.
(3) Delays due to customs clearance or force majeure are outside the provider's control and do not give rise to claims for damages.
(4) The goods remain the property of the provider until the purchase price has been paid in full.
§ 6 Right of withdrawal
(1) Consumers have a statutory right of withdrawal. The details are set out in the withdrawal policy, which the customer can view during the order process and on the "Withdrawal & returns" page.
(2) The right of withdrawal does not apply to contracts for the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene, if their seal was removed after delivery (Section 312g (2) no. 3 of the German Civil Code). This includes the dietary supplements sold by the provider; the seal consists of a plastic wrap around the container.
§ 7 Voluntary satisfaction guarantee ("money-back guarantee")
(1) In addition to and independently of the statutory right of withdrawal, the provider grants the customer a voluntary 30-day satisfaction guarantee subject to the following terms:
(2) At the customer's request, the provider refunds the purchase price for up to one (1) opened product unit per order, provided the customer requests the refund in writing (for example by email to support@chi-drops.com) within 30 days of receiving the goods.
(3) For all further units in the same order the following applies: if they are unopened and in their original seal, they must be returned at the provider's request and at the customer's cost to the return address provided by the provider. The corresponding share of the purchase price is refunded after the return has been received and reviewed.
(4) The money-back guarantee does not limit the customer's statutory rights, in particular the right of withdrawal and warranty rights.
§ 8 Liability for defects (warranty)
(1) The statutory rights regarding defects under Sections 434 ff. of the German Civil Code apply.
(2) The customer is asked to report obvious transport damage to the carrier and to inform the provider about it. Failing to give this notice has no effect on the customer's statutory rights regarding defects, but it helps the provider pursue its own claims against the carrier.
§ 9 Liability
(1) The provider is liable without limitation under the statutory provisions in cases of intent or gross negligence, for injury to life, body or health, under the provisions of the German Product Liability Act, and to the extent of any guarantee assumed by the provider.
(2) In the case of slightly negligent breach of an obligation that is essential to achieving the purpose of the contract (cardinal obligation), the provider's liability is limited in amount to the damage that is foreseeable and typical for this type of transaction.
(3) Otherwise the provider's liability is excluded.
§ 10 Notes on dietary supplements
(1) The products offered in the store are dietary supplements and not a substitute for a balanced and varied diet or a healthy lifestyle.
(2) The products are not suitable for children, pregnant women or breastfeeding women. People with pre-existing conditions or on ongoing medication should seek medical advice before taking them.
(3) Do not exceed the stated daily intake. Keep out of reach of small children.
§ 11 Choice of law, place of jurisdiction
(1) The law of the State of Wyoming applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not remove the protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence (Article 6 (2) of the Rome I Regulation).
(2) Consumers within the meaning of these Terms and Conditions may bring claims arising from this contract before the court of their place of residence.
§ 12 Dispute resolution
(1) The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/.
(2) The provider is neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
§ 13 Final provisions
(1) Should individual provisions of these Terms and Conditions be or become invalid, this does not affect the validity of the remaining provisions.
(2) The provider reserves the right to amend these Terms and Conditions at any time with effect for the future. For contracts already concluded, the version in force at the time the contract was formed applies.
